三星“太子”抱怨判5年太长？二审检方要求判12年

　韩国三星电子副会长、集团实际控制人李在镕一审被判５年监禁后，他本人抱怨刑期太长，提起上诉；作为检方的特别检察组则认为判刑太轻，也提起上诉。在本月２７日二审过程中，检方再度提请法庭判处李在镕１２年监禁。

　　今年８月２５日，首尔中央地方法院裁定李在镕行贿、挪用公款、非法转移资产、隐匿犯罪收入和作伪证５项罪名全部成立，判处５年监禁。

　　特检组在一审中主张，李在镕向时任总统朴槿惠的“亲信”崔顺实承诺和实际贿赂总额达４３３亿韩元（约合２.６４亿元人民币），以换取朴槿惠政府在２０１５年三星集团旗下两家子公司的合并案中给予政策方便，而该合并有助于身为三星电子副会长的李在镕加强对整个三星集团的掌控。

　　虽然一审法庭裁定李在镕与朴槿惠之间存在默许的请托关系，但并不认为特检组指控的所有款项都是贿款，只认定其中７２亿韩元（４３９８万元人民币）为贿款，因此判处李在镕５年监禁，其余公司高管则判处２年半至４年不等。

　　在本月２７日二审过程中，特别检察官朴英洙当庭表示，“这是一桩官商勾结的典型案例”，李在镕为继承经营权贿赂总统及其亲信。

　　朴英洙说，上述被告人为崔顺实购买顶级赛马，非法赞助为崔顺实牟取私利的基金会，却美其名曰回馈社会，这是对所谓“公司慈善事业”的亵渎。

　　韩联社报道，特检组在二审中要求对李在镕判处１２年监禁，并寻求对另外４名三星高管分别判处７年至１０年监禁。此外，特检组向法庭提请追回这些被告转移到境外的７８.９亿韩元（４８１９万元人民币）资产。

　　李在镕２７日再次否认所受指控，声称自己曾于２０１４年心脏病发作，因此根本无意夺取三星集团的继承权。他说：“我不明白‘继承经营权’是指什么，我从未接受朴槿惠的要求，以图换取（她帮助我）夺取公司继承权。”

　　因涉“亲信干政”案，朴槿惠已于今年３月遭弹劾，成为韩国历史上首位被弹劾罢免的总统，失去司法豁免权。３月３１日，朴槿惠被法院批捕，随后关押在首尔看守所。４月１７日，检方以涉嫌收受贿赂、滥用职权等１８项罪名起诉朴槿惠，拘留期限为６个月，即１０月１６日到期。１０月１３日，法院裁定将朴槿惠的关押时间延长６个月，以继续调查此案。
